1. Purpose
This Legal Notice and set of Terms of Use (hereinafter the “Terms”) sets out the terms and conditions governing the operation of the website www.lesquatresaisons-djerba.com (hereinafter the “Website”), operated by Les Quatre Saisons Djerba hotel (hereinafter the “Publisher”), and the conditions under which any person accessing it (hereinafter the “User”) is permitted to use it.
In accordance with applicable Tunisian legislation, and in particular Law No. 2000-83 of 9 August 2000 on electronic exchanges and electronic commerce, the User is informed of these Terms prior to entering into any online contract.
Access to and use of the Website constitutes full and unconditional acceptance of these Terms by the User. Should the User disagree with any part of these Terms, the User is advised to refrain from using the Website.
These Terms are distinct from the General Terms and Conditions of Sale (“GTC”) applicable to stay bookings, which specifically govern the contractual relationship between the hotel and the customer in connection with a reservation (payment terms, cancellation policy, deposits, pricing policy, etc.).

4. Definitions
User: any natural person browsing the Website or any of its services, whether or not a booking is made.
Guest: any User who has made a booking for accommodation, dining, spa, or activity services offered by the hotel.
User Content: any data, information, or file submitted by the User to the Website (contact forms, reviews, comments).
Publisher: Les Quatre Saisons Djerba hotel, operator of the Website.

5. Access to the Services
The Website is accessible free of charge, from any location, to any User with internet access. Costs incurred by the User in accessing the Website (hardware, software, internet connection) remain the sole responsibility of the User.
The Publisher uses reasonable means at its disposal to ensure continuous, quality access to the Website. This is an obligation of means (obligation de moyens) rather than an obligation of result; the Publisher cannot guarantee uninterrupted, error-free operation, or compatibility with any particular hardware.
Access to the Website may be suspended, interrupted, or restricted without prior notice for maintenance, technical updates, or any other reason deemed necessary by the Publisher, without the Publisher’s liability being engaged as a result.

7.1 Purposes and Basis of Processing
Personal data collected via the Website (contact form, booking form, newsletter subscription) is processed for the following purposes: managing booking and stay requests, responding to contact inquiries, managing the customer relationship, and, subject to the User’s consent, sending commercial communications.
Fields marked as mandatory at the point of collection are necessary for the Publisher to process the relevant request; failure to complete them will prevent the Publisher from acting upon it.

7.2 Retention Period
Data is retained for the period necessary to fulfil the purposes for which it was collected, extended, where applicable, by any statutory limitation periods applicable under accounting and tax regulations.

7.3 User Rights
In accordance with applicable regulations, the User has the right to access, rectify, erase, and object to the processing of their personal data, as well as, where applicable, the right to restrict processing and to data portability. These rights may be exercised:
